1. Introduction
These Terms of Service ("Terms") govern your use of www.exuma-blue.com (the "Site") and any purchase you make from Exuma Blue Jewellery Ltd ("Exuma Blue", "we", "us", "our"). By using the Site or placing an order, you agree to be bound by these Terms. Please read them carefully.
2. About us
Exuma Blue Jewellery Ltd is a company registered in England and Wales (Company Number 16701704). Our registered office is 20 Wenlock Road, London N1 7GU, England.
3. Our products
Exuma Blue jewellery is handcrafted to order using natural materials, including coconut, gemstones, natural shell, wood, sea beans and hand-knotted rope. Small variations in colour, grain, size and marking are inherent to each piece and celebrated as part of the design; no two pieces are ever exactly alike. Product images are provided as accurate representations, but we cannot guarantee that colours displayed on your device precisely match the finished item.
4. Ordering and prices
All prices on the Site are shown in Pounds Sterling (£) and are inclusive of UK VAT where applicable. Prices for international orders may not include local sales taxes or import duties, which are the responsibility of the recipient.
By placing an order, you are making an offer to purchase, which we may accept or decline at our discretion. A contract is formed only once we have confirmed your order by email.
5. Payment
Payment is required in full at the time of order. We accept payment through the providers listed at checkout.
6. Made to order
Every Exuma Blue piece is made to order in London. Production typically takes two to three weeks. If you have a specific date in mind, please contact us before placing your order and we will do our best to accommodate.
7. Delivery
Please see our Shipping Policy for information on delivery timelines, costs and international shipping. Delivery estimates are indicative and not guaranteed. Risk in the goods passes to you on delivery.
8. Cancellation, returns and refunds
Please see our Refund Policy for full details of your right to cancel, our return process, and how faulty pieces are handled. Nothing in these Terms limits your statutory rights.
9. Intellectual property
All content on the Site including designs, product images, editorial photography, text, logos and brand assets is the property of Exuma Blue Jewellery Ltd or its licensors and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute, display, adapt or use any content without our prior written permission.
10. Warranties and liability
We warrant that the products we supply will conform to their description and be of satisfactory quality.
Where you buy as a consumer, we do not exclude or limit any statutory rights available to you, including those under the Consumer Rights Act 2015, the Consumer Protection Act 1987, and any other applicable consumer protection legislation. Nothing in these Terms affects those rights.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
Subject to the above, and to the fullest extent permitted by law, we will not be liable for any loss that was not reasonably foreseeable at the time you entered into your contract with us, or for any loss arising from a use of our products other than their intended use.
11. Force majeure
We are not liable for any failure or delay in performance where such failure is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, disruption of transport or supply chains, industrial action, or acts of government.
12. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales.
Where you buy as a consumer, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country in which you are habitually resident. You may bring proceedings in respect of these Terms either in the English courts or in the courts of the country in which you reside, and any mandatory local consumer protection laws will continue to apply.
13. Changes to these Terms
We may update these Terms from time to time. The most current version will always be posted on the Site.
